Marc DeSisto Appears Before US Supreme Court
On March 24, 2021, Attorney Marc DeSisto appeared before the Supreme Court of the United States for oral argument in Caniglia v. Strom. Representing the City of Cranston and several of its police officers—who were sued by a Cranston resident claiming violations of his Fourth Amendment rights after he was transported to a hospital for a psychological evaluation and two firearms were seized from his home in 2015—DeSisto argued that the officers lawfully performed their community caretaking function.

DeSisto Law Attorney Participates in Federal Court’s Litigation Academy
Attorney Caroline Murphy is actively involved in the Federal Court’s Litigation Academy, both as a participant and a demonstrator. Most recently, Caroline was involved in a mock remote bench trial as one of two attorneys demonstrating best practices for conducting court proceedings with Zoom technology. This program was offered as a Continuing Legal Education (CLE) course by the Federal Court to encourage attorneys to conduct trials remotely during the COVID-19 pandemic.

DeSisto Law Participates in Three Socially Distanced Civil Jury Trials
In October 2020 (during a lull in the pandemic), the U.S. District Court for the District of Rhode Island held three in-person civil jury trials under strict public health and safety standards. DeSisto Law took part in all three. The Court implemented several measures to provide for social distancing while still ensuring an efficient trial, including glass partitions at the bench, witness stand, and counsel tables, and breaks every 90 minutes to clear the room and recirculate the air. All participants were masked, and witnesses used clear masks to better ensure clear testimony. Although the courthouse remained closed to the public, all three trials were broadcast on Zoom.

DeSisto Law Represents City of Cranston in US Supreme Court
DeSisto Law is currently representing the City of Cranston, Rhode Island before the United States Supreme Court. A Cranston resident brought suit against the City and several of its police officers in 2015 after he was transported by ambulance to a nearby hospital for a psychological evaluation and two firearms were seized from his home. The resident challenged these actions as violative of his Fourth Amendment rights. In 2019, DeSisto Law successfully obtained summary judgment in the matter from the United States District Court for the District of Rhode Island, after arguing that the officers lawfully performed their community caretaking function. The United States Court of Appeals for the First Circuit then affirmed on the same grounds in 2020. The matter now proceeds to the US Supreme Court, with oral arguments expected in March 2021.
